The present document sets forth the terms and conditions governing the use of the website high-oleic.eu and the purchase of products marketed therethrough. By placing an order, the Client confirms that he has read, understood and accepts in full these Terms and Conditions.

1. Identification of the Seller

hereinafter referred to as the "Seller"..

2. Definiții

Seller – the person identified at Section 1.
Client / Buyer – any natural or legal person who places an order via the Site.
Consumer – any natural person acting for purposes outside his trade, business or profession, in accordance with Government Ordinance No. 21/1992.
Site – website-ul high-oleic.eu.
Products – the cold-pressed oils and other goods offered for sale on the Site.
Order – the firm request of the Client to purchase one or more Products.
Contract – the distance selling contract concluded between the Seller and the Client, without the simultaneous physical presence of the parties.

3. Subject Matter of the Contract

The Seller offers for sale via the Site cold-pressed vegetable oils and related food products, artisanally produced. The present terms shall apply to all sales concluded through the Site.

The contractual relationship shall be governed by:

Government Emergency Ordinance No. 34/2014 on consumer rights in distance contracts (transposing Directive 2011/83/EU);
Legea nr. 365/2002 privind comerțul electronic;
Government Ordinance No. 21/1992 on consumer protection;
Ordonanța de urgență a Guvernului nr. 140/2021 privind vânzarea de bunuri și garanțiile asociate;
Regulation (EU) 2016/679 (GDPR) on the protection of personal data;
Regulation (EU) No 1169/2011 on the provision of food information to consumers.

4. Products and Information Thereon

4.1. The characteristics of the Products (designation, composition, nutritional values, net quantity, shelf life, storage conditions) are displayed on the page of each Product and upon its label, pursuant to Regulation (EU) No 1169/2011.

4.2. The images of the Products are for presentation purposes only. Minor differences in hue or appearance may occur owing to the natural, unrefined character of the Products (for example, variations in colour or slight turbidity at low temperatures), which do not affect quality.

4.3. The Customer is obliged to read the information on the label prior to consumption, in particular that concerning ingredients, allergens, storage conditions and shelf life.

4.4. The Seller reserves the right to amend at any time the range of Products, the prices and availability thereof, without prior notice.

5. Prețuri

5.1. The prices of the Products are expressed in lei (RON).

5.2. The Seller is exempt from VAT; the prices displayed are final prices.

5.3. The delivery charge (shipping) is not included in the price of the Products and is displayed separately prior to completion of the order.

5.4. The applicable price shall be that displayed on the Site at the time the order is placed.

6. Order Placement and Conclusion of the Contract

6.1. The Customer shall place the order by adding the Products to the basket and completing the checkout steps.

6.2. Upon placing the order, the Customer shall receive an e-mail confirming receipt of the order. Such e-mail is for information purposes only and shall not constitute acceptance of the order.

6.3. The Contract shall be deemed concluded upon confirmation by the Seller of the dispatch of the Products.

6.4. The Seller reserves the right to cancel an order, upon notifying the Customer and refunding in full any sums that may have been paid, in circumstances such as: unavailability of the Product, manifest pricing errors, or inability to effect delivery to the address indicated.

7. Methods of Payment

Payment may be effected as follows: 1. Cash upon collection — payment in cash directly upon collection of the Products.
2. Cash on delivery — payment in cash or by card to the courier upon delivery of the parcel.
3. Online card payment — secure payment via Netopia mobilPay / EuPlătesc / , an authorised online payment processor. Card details are entered directly on the processor's platform and are not stored by high-oleic.eu.

online card payment, via a secure payment processor;
bank transfer (Payment Order) to the account indicated upon completion of the order;
cash on delivery (cash/card to the courier).

The Seller shall not store the Customer's card data; card payments shall be processed exclusively through the authorised processor.

8. Delivery of the Products

8.1. Delivery shall be effected by courier within the territory of Romania, subject to the courier's coverage.

8.2. The estimated delivery term is 1–5 working days from confirmation of the order and, as the case may be, from confirmation of payment.

8.3. The cost of delivery is displayed prior to finalisation of the order and shall be borne by the Customer, save where the Seller announces an offer of free delivery.

8.4. The risk of loss or deterioration of the Products shall transfer to the Customer at the time of physical receipt thereof.

8.5. Upon receipt of the parcel, the Customer is kindly requested to verify the integrity of the packaging. Any visible damage must be reported to the courier at the time of delivery.

9. Right of Withdrawal (Renunciation of the Contract)

9.1. Pursuant to Art. 9 of GEO No. 34/2014, the Consumer shall be entitled to withdraw from the contract, without being required to give reasons and without incurring costs other than those provided by law, within 14 calendar days from the date on which he takes physical possession of the Products.

9.2. Important exception – food products. Pursuant to Art. 16 of GEO No. 34/2014, the right of withdrawal shall not apply to:

sealed products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the Consumer after delivery (art. 16 lit. e);
products liable to deteriorate or expire rapidly (Art. 16 lit. d).

As the products traded are food products, the right of withdrawal shall be exercised as follows:

unopened products, sealed, in their original packaging and in an unaltered condition pot fi returnate în termenul de 14 zile;

9.3. In order to exercise the right of withdrawal, the Consumer shall inform the Seller by means of an unequivocal statement (for example, by e-mail to info@high-oleic.eu), prior to the expiry of the 14-day period.

9.4. The cost of returning eligible Products shall be borne by the Consumer, save where the Product is non-conforming.

9.5. The Seller shall reimburse the sums received within no more than 14 days from the date on which he is informed of the withdrawal, and may defer reimbursement until receipt of the returned Products.

10. Legal Guarantee of Conformity

10.1. The Products shall benefit from the legal guarantee of conformity in accordance with GEO No. 140/2021.

10.2. The Seller shall be liable for any lack of conformity existing at the time of delivery. The following shall not constitute a lack of conformity: consumption after expiry of the best-before date, improper storage by the Client (for example, exposure to heat or light), or natural variations in a correctly stored unrefined product.

10.3. Complaints regarding conformity shall be addressed to info@high-oleic.eu or to Băcilă Stelian, Sat Tălmăcel, No. 380, Oraș Tălmaciu,

Sibiu County, 555706, Romania, accompanied by proof of purchase.

11. Complaints and Dispute Resolution

11.1. Any complaint may be submitted to info@high-oleic.eu or by telephone on +40 733 792 322.

11.2. The competent authority in the field of consumer protection is The National Authority for Consumer Protection (ANPC) The National Authority for Consumer Protection (ANPC) – www.anpc.ro.

11.3. For alternative dispute resolution, the Consumer may have recourse to the ADR/ODR platform:

12. Protection of Personal Data

12.1. The Seller shall process the Client's personal data in accordance with Regulation (EU) 2016/679 (GDPR), solely for the purpose of processing orders, delivery and fulfilment of legal obligations.

13. Intellectual Property

The entire content of the Site (texts, images, logos, graphic elements, the brand name "Stelian") is the property of the Seller or is used under licence and is protected by legislation on copyright and intellectual property. Reproduction without written consent is prohibited.

14. Force Majeure

Neither Party shall be liable for failure to perform its contractual obligations if such failure is caused by an event of force majeure, as provided by law.

15. Governing Law and Jurisdiction

The present contract shall be governed by Romanian law. Any disputes shall be settled amicably or, failing that, by the competent courts of Romania, without prejudice to the Consumer's right to have recourse to alternative dispute resolution entities.

16. Amendment of the Terms and Conditions

The Seller reserves the right to amend the present document at any time. The version applicable to an order shall be that published on the Site at the time the order is placed.

17. Final Provisions

Should any provision of the present document be declared null or unenforceable, the remaining provisions shall remain valid. Use of the Site and the placing of an order shall constitute full acceptance of these Terms and Conditions.
